By downloading, installing, or using the NM-TV Command Center application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

The NM-TV Command Center is a desktop application designed to simplify the setup, configuration, and monitoring of NM-TV and compatible ESP32-based Bitcoin solo mining hardware. The App provides features including, but not limited to:

• Automatic detection of compatible mining hardware over USB and local networks.
• A guided setup wizard for WiFi and wallet configuration.
• Real-time monitoring of mining statistics (hashrate, temperature, shares).
• Remote management of hardware settings.

3. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.

4. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal or internal business purposes.

You may not:

• Copy, modify, or distribute the App or any portion of it.
• Reverse engineer, decompile, or disassemble the App.
• Sell, sublicense, or commercially exploit the App without our express written permission.
• Use the App in any way that violates applicable local, national, or international law or regulation.

5. Hardware & Third-Party Requirements

The App is designed to work with NM-TV official hardware and compatible ESP32 development boards. Certain features require a valid NM Lotto license for non-official ESP32 hardware. Purchasing hardware or licenses from NMMiner Official is subject to their own terms and conditions.

Solo Bitcoin mining involves connecting to third-party mining pools. The operation, availability, and terms of those pools are entirely outside our control. We are not responsible for any losses related to mining pool downtime, changes in pool policies, or cryptocurrency market fluctuations.

6. Cryptocurrency Disclaimer

Solo Bitcoin and cryptocurrency mining is a speculative activity. The NM-TV hardware operates as a lottery-style miner with statistically low odds of finding a block. We make no representations, warranties, or guarantees regarding:

• The likelihood of finding a block or earning any cryptocurrency rewards.
• The profitability of mining relative to electricity costs.
• The future value of any cryptocurrency.

You use the App and engage in mining at your own risk. Nothing in the App or on this website constitutes financial or investment advice.

7. User Responsibilities

You are solely responsible for:

• The security of your device, local network, and cryptocurrency wallet addresses.
• Ensuring your use of the App complies with all applicable laws in your jurisdiction, including any laws regarding cryptocurrency mining.
• Any electricity costs and hardware wear associated with running mining equipment.
• Keeping your App installation up to date to benefit from security improvements.

8. Intellectual Property

All intellectual property rights in the App, including but not limited to software code, design, logos, and documentation, are owned by us or our licensors. Nothing in these Terms grants you any right, title, or interest in any intellectual property beyond the limited license described in Section 4.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that any defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim. If the App was free of charge, our total liability shall not exceed €50.

11. Changes to the App and Terms

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without notice. We also reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Germany.
